Guys, I almost didn’t publish this module to the ebook. Even then, it didn’t make sense to make it free, like any other update we do to the ebook. The reason is that this is the only claim system that we know of that you really, honest to goodness, can use to make incredible money online, from your home, without having to go to the court house.

No, I’m not kidding. And, yes, I realize that a lot of you will throw a ‘jab’ at me because I’m the only one that is telling the truth online regarding the need to go to the courthouse to do research on surplus funds, excess proceeds, and estate monies. The excess proceeds, estates and surplus funds arenas are still very lucrative. And yes, they have much larger individual payouts.

But, if you’re in a State where it is difficult to get the list, we highly recommend you consider bankruptcy claims to supplement your income, or to make money without having to drive to the court house. And YES, YOU CAN ACTUALLY DO THIS WITH NEXT TO NOTHING OUT OF POCKET!

Another reason we almost didn’t add this module to the book is that we have the structure and staff in place to do this ourselves, from the office, without getting anyone else involved. But, we were able to secure agreements with banks to do large ‘sweeps’ on their behalf. As a result, we will not be going after funds from individuals, companies, or smaller institutions.

Obviously, this is the ‘first version’ of this module, so you need to bear with us as we ‘tweak it’ based on feedback. You also need to treat this as a completely different ‘animal’ than the surplus funds, excess proceeds or estate arenas. There are some similarities, but this is completely different.

Okay, let’s start with where unclaimed bankruptcy monies come from.

As you know, folks claim bankruptcy to eliminate debt or make it more manageable. What you might not know is that bankruptcy can also involve the liquidation of assets. In that instance, a bankruptcy trustee reviews the case and decides where any monies created from the liquidation (sale) of assets will go (I am simplifying the procedure because it is not necessary for you to know the legal aspects of this, and, frankly, I’m not an attorney and don’t need to know all the ins and outs either!).

Once the trustee and court decide who is owed the monies, the bankruptcy court literally cuts checks to the individuals or entities (usually called creditors, which they are) that are owed the money. They then send the checks out to the address that they have on file. More frequently than you might think, the checks come back(either physically or as a result of the check payment time period expiring) to the bankruptcy court.

This can happen for a variety of reasons including but not limited to wrong addresses, no forwarding addresses, an individual disregarding or losing the check, etc. Regardless of the reason for this, the bankruptcy court ends up with the monies and makes little or no effort to contact the person or entity entitled. They post a list (in the majority of cases) on their web site, and leave it at that.

The great thing about most of the online lists is that they will often tell you who the debtor was, who the creditor was, how much money it is, the last known address of the claimant, whether or not a claim has been filed, etc. And, many of the bankruptcy courts have the case information online for you to look through. If not, they usually use Pacer™, a company that specializes in court documents.

The other great thing about this particular type of monies, is that they are constantly being added to. Unless you’ve been under a rock, you know that the economy has been in a horrible state since late 2007 and that bankruptcies are at all time highs. This will not slow down any time soon.

So you will be able to ‘go back to the well’ over and over!

Okay, now let’s talk about the dollar amount of the files and why it doesn’t matter. The average unclaimed check in the bankruptcy court is around $500 (yes, there are some in the tens of thousands, and some under $100).

Let’s address your concerns about this dollar amount.

Why an average of $500 in unclaimed funds, in bankruptcy court should make it not worth your while…. WRONG!

The skip tracing is difficult. We can’t afford to hire a PI or use a subscription system to find the folks. WRONG – you are almost always looking for creditors, people that are owed money for some reason. Many are small businesses. The address is usually available online. Heck, they usually – if they are businesses – even have websites you can easily find. Further, if they’re a business, they are often listed on the State’s online list of corporations (Secretary of State is a great start in most States).

The upfront buyout I need to pay them is negligible, and not worth the creditor’s time. WRONG – here’s where it gets really interesting. First of all, they’ve written off this debt completely. Secondly, YOU DON’T HAVE TO BUY OUT THEIR INTEREST. YOU CAN DO THIS ON CONTINGENCY.

The attorney’s fees would kill my profit. WRONG. In most bankruptcy courts, you will NOT have to petition for the funds. You can get the money without an attorney! If you come across a bankruptcy court that says they want you to petition for the money, call and double check. If they are ‘sticking to their story’, go to another court!

It’s not enough money to be worth my time. WRONG. Guys, you can get these deals put together paying as little as 10-15% to the claimant(usually 25% on contingency), and it’s based on the money that can be claimed, not on the gross amount from the instrument (judgment, lien, etc.).

So on a $500 claim, let’s say you pay the claimant 25%. You still have $375. And it may cost you $2 in mailing costs, and $30 to record the transfer to your name with the court. Then you apply with the bankruptcy court (usually online!) and email them copies of the documents. So you just made $343. And you didn’t have to pay to find the claimant, pay for an attorney, or step foot in the court house. You pay only when you collect.

AND, since it will take you maybe 20 minutes in online work and the call to the individuals, mailing, etc., you can do a minimum of 8/day, working it 9-5(that’s assuming you only convert 1/3^rd of the deals you contact!). That is – in case you missed it - $343 per HOUR. Most attorneys that I know can’t get that rate.

That is – in case you’re like me and want to figure out the payout - $2,744/day(8 hour day), $13,720/wk (5 day week), $58,996/mo (4.3 weeks in each month). Are you ready for this? That is $668,560/year (working 48 weeks out of the year, 5 days per week, 8 hours per day). What?!

PART TIME: Figure it on 1 (one) hour per day. That’ $343 per day, $1,715/wk (5 day week), $7,374.5/month (4.3 weeks in a month). Get ready… Work 1 hour per day, 5 days per week, 48 weeks per year and you make – drum roll please - $82,320/year!

Okay, the online ‘powers that be’ are going to make me say this:

That is an example (yes, I think its attainable, are you kidding me!), individual results may vary (that’s code for if you don’t work or can’t follow directions, you’re out of luck and you need to stick with asking if they want fries with that), blah, blah, blah. Bottom line, guys, work it and make it!

Every weekday, property sells at foreclosure, both by municipalities and Counties(tax sale foreclosure) and through mortgage foreclosure. Of course, estates are being funded daily where heirs are nowhere to be found. AND, bankruptcy trustees are cutting checks that no one is claiming!. This has been going on for decades. Yet hardly anyone knows about the monies - even the attorney's that hand the monies over to the courts!

What they don't know is that homes often actually sell for more than the foreclosing bank is or entity is entitled to. And they don't realize that we have become a reality tv show Nation, with heirs never being told about monies they are due and creditors overlooking payouts on bankruptcy courts every day! The same is true for foreclosures from tax liens.

Here's a Foreclosure example:

Let's say a home forecloses for $250,000 and the bank debt totals $200,000, including attorney's fees.

The bank is not allowed to keep the overage. So where does that money go?

The bank or substitute trustee gives that money to the Clerk of the Court for the County. That way, anyone with a judgment or lien doesn't lose out on collecting from the proceeds. Or, if there are no liens or judgments, the ex-owner can collect the equity the bank isn't entitled to. (The Clerk and/or Treasurer doesn't keep the list! They'll even tell you the money doesn't exist. You have to ask the right person, and We'll Teach You How to Ask, and Who to Ask!)

The problem is that the County doesn't have the time or manpower to contact anyone. Okay, the County is also allowed to keep the interest on money while they hold it, so there is some incentive to hold onto it - but we don't want to get all 'conspiracy theory' on you (Was that a black helicopter I just saw? Why do I suddenly feel compelled to buy 'Catcher in the Rye?...)

Okay, so you're saying, 'Yah, but houses are selling for less than the bank is owed'. You're right - over the past few years, homes often sold for under the amount owed. But not always. More importantly, you can often go back years and even decades looking for surplus. And here's the big misunderstanding:

If a homeowner had a loan for $100K in 2003, and took out a second for $200,000 in 2006 because the market took off.... The first mortgage is going to foreclose on the house, probably sell it for $150,000 (it was worth $300,000 in 2006) and get their $100,000. There's $50,000 sitting there. It's due to the second mortgage company, which has either sold its debt (the mortgage) or gone out of business. The money is still there!!

Do the math. Assume an average County has only 2 foreclosures/month with overage and the average overage is only $5,000. These are seriously conservative numbers, guys. That's $120,000 generated in surplus funds per yr, per County. Over 50 yrs, that's $6 Million/County. There are approximately 100 Counties in any given State. That's $600,000,000 - Six Hundred Million Dollars - per State. With 50 States, we're talking $30,000,000,000 - Thirty Billion Dollars, Nationally!

Let me clue you guys in. It's way more than that. When we have a downturn, everyone gets hit, not just folks without equity. It would not surprise us if the number was closer to $100,000,000,000.

Think they want to give the principal to the owners, when they can make interest on $100 Billion Nationally?

Now Let's Talk About Estate Monies and Bankruptcy Monies - NOONE IS TEACHING THIS ANGLE!

Estate Monies:

Folks die. That's a given. What is also a 'given' is that folks die without keeping in touch with their kids or heirs. Even when the kids know that there may be monies, the State often 'hides' the money in such a way that they can't find it. We worked on a case where a granddaughter was the 'last man standing'.
